An intoxicated driver, while trying to frighten and intimidate the plaintiff, lost control of his vehicle and struck the plaintiff. The victim was a pedestrian on foot. The collision resulted in a broken hand and a torn shoulder which required surgery to repair. The defendant fled the scene; however, an investigation led to his stop and arrest. He was charged for driving under the influence, vehicular assault, and leaving the scene of an injury accident.
